Mesopotamian and Hebrew practice of law both possessed certain characteristics that beget become essential aspects of current legal systems. These two early(a) editions of law have different origins and it is important to analyze the pose in which each legal system was instituted. Mesopotamian law is a series of precedents or judicial verdicts that were based off of extempore laws or customs. The Hebrew law or Torah however, is a divinely written document containing specific laws. Mesopotamian law, besides known as Hammurabi’s “Code”, is based on a document known as the stele. The top or header of the stele features a drawing of the god Marduk crowing Hammurabi royal power. The stele contains three-thousand five-hundred extant lines that include a prologue, epilog, and two-hundred 82 articles. All the articles are written in the conditional form (if p then q) and are verdicts that Hammurabi has made himself.
The “Code” originates approximately 1750BCE and during this time the people of Mesopotamia had no sense of guilt or contrition, and it is important to note that there is no line between positive and natural law in this legal system. As a matter of fact, the Babylonians did not even have a word for law or principle.
